These Terms and Conditions ("Terms") govern your use of Muse, an AI-powered fashion search engine (the "Service"). By accessing or using Muse, you agree to comply with these Terms. Muse reserves the right to update these Terms at any time. Changes take effect upon posting, and your continued use of the Service indicates your acceptance of the revised Terms.

1. User Accounts and Data Collection

Muse offers certain features only to registered users. When you create an account, you agree to provide accurate, complete, and current information and to maintain the confidentiality of your login credentials.

We collect personal information (such as your name and email), preferences (such as style and brand preferences), and usage data to personalize your experience and improve the Service. Data is collected and processed in accordance with our Privacy Policy.

You may delete your Muse account at any time. Upon request, we will remove your personal data from our active systems, subject to any legal retention obligations.

2. Use of Input Data

Muse allows users to provide input via text and by uploading images (e.g., photos of fashion items). You retain ownership of any content you submit.

By submitting content, you grant Muse a limited license to process it for the purposes of delivering search results and enhancing our services. Muse does not sell or share user-submitted content with third parties.

Muse may use anonymized and aggregated data to train and improve its AI models. If an opt-out feature is available in your settings, you may opt out of such model training.

3. Affiliate Marketing

Muse may participate in affiliate marketing programs. This means some product links on the site may be affiliate links. If you click a link and make a purchase, Muse may earn a commission from the retailer at no additional cost to you.

Muse only links to retailers and products we recommend or trust. Your interactions with third-party websites are solely between you and the third party. Muse is not responsible for any purchases made outside of our platform.

4. Restrictions on Use

By using Muse, you agree to the following:

Personal, Non-Commercial Use: Muse is for your personal use only. You may not copy, distribute, sell, or exploit any content, including AI-generated results, without written permission from Muse.

No Unauthorized Branding: You may not use Muse's name, logo, trademarks, or any branding without express prior authorization.

No Impersonation: You may not impersonate Muse, its staff, or misrepresent your affiliation with the platform.

No Unlawful Use: You agree not to violate any laws or third-party rights while using the Service.

Violation of these restrictions may result in account suspension or termination.

5. Prohibited Content and Use

You may not use Muse to:

Search for or upload illegal, explicit, defamatory, hateful, or otherwise inappropriate content.

Engage with content unrelated to fashion (e.g., gambling, hate speech, or pornography).

Overload or abuse the AI system.

Attempt to reverse-engineer or extract proprietary data from the platform.

Abusive or unlawful use may result in immediate termination of access.

6. Intellectual Property

All content provided by Muse—including AI-generated content, interface elements, and design—is the intellectual property of Muse or its licensors.

User-Submitted Content: If you post reviews, ratings, or other written content, you grant Muse a non-exclusive, worldwide, royalty-free license to use and display that content in connection with the Service.

User-Uploaded Images: You retain ownership of any images you upload. Muse may process these solely for the purposes of providing results and improving image-based AI. We do not use, share, or distribute your images beyond these purposes without your explicit consent.

7. Disclaimers and Limitation of Liability

Muse is provided on an "as-is" and "as-available" basis. We make no guarantees regarding:

Accuracy or reliability of search results

Availability or uninterrupted use of the Service

Suitability of AI-generated content for any purpose

Muse is not responsible for:

Errors or omissions in search results

Unauthorized access or misuse of your account

Actions taken by minors without parental consent

Third-party product availability, pricing, or quality

To the maximum extent permitted by law, Muse shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Service. Your sole remedy is to stop using the Service.

8. Modifications to the Service and Terms

Muse may modify or discontinue any part of the Service at any time without notice. We may also update these Terms from time to time. Changes are effective upon posting. You are responsible for reviewing these Terms regularly.

Continued use of Muse after changes means you accept the revised Terms.

9. Dispute Resolution

Before initiating formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting Muse support.

If informal resolution fails, both parties agree to resolve disputes through binding arbitration in accordance with the rules of a recognized U.S. arbitration body (e.g., AAA or JAMS). Arbitration may be conducted virtually or in a mutually agreed location. Each party is responsible for its own legal fees.

This provision does not prevent either party from seeking temporary injunctive relief or filing a claim in small claims court.

10. Governing Law

These Terms are governed by and interpreted under the laws of the United States of America, without regard to its conflict-of-law provisions. Any disputes not subject to arbitration shall be resolved in a court of competent jurisdiction in a U.S. location of Muse's choosing.
